Barcelona tenants must act quickly to secure rental contract extensions. A Spanish government decree, which allows these extensions, expires in less than 20 days. This urgent call comes from tenant advocacy groups.

The Sindicat de Llogateres (Tenants’ Union) and the Plataforma d’Afectats per la Hipoteca (PAH, Platform for Mortgage Victims) are intensifying their appeal. They urge tenants to utilise this opportunity while the decree remains active. Carme Arcarazo, spokesperson for the Sindicat de Llogateres, advised tenants “not to fall asleep” and “not to wait until the end of the month.” This is due to the limited window for requesting the extension. The Sindicat de Llogateres has already received nearly 2,000 requests for its burofax template. This template helps tenants process their extension applications.

Both the Sindicat de Llogateres and PAH recommend sending these requests via burofax from a Post Office. The Tenants’ Union has published an urgent guide. This guide explains how contracts can be extended for two years. Extensions can reach three years in designated “tensioned areas.” This applies regardless of the property owner’s or real estate agency’s response. Jurist Pablo Feu confirmed the owner’s obligation to accept the right of extension. He stated this remains valid even without a burofax response. “It is the owner’s obligation to accept it and it does not depend on whether they respond or not,” Mr Feu told EFE. “The tenant does not ask for anything, they only inform them that they are exercising their right, and the right is not given by the owner, but by the decree-law, which does not depend on anyone’s arbitrariness.” This legal interpretation provides a strong basis for tenant action.

Tenant Protections and Owner Concerns

The Sindicat de Llogateres advises tenants to distrust communications from property owners. They also recommend tenants not to vacate their homes even if the contract has ended. The union’s guide states, “Many are not valid or can be challenged.” The Sindicat de Llogateres also warns that “it is common for the owner not to want to accept these measures because they go against their plans to continue doing business with our lives.” This highlights the tension between tenant protections and landlord interests in Barcelona’s competitive housing market. Barcelona, a city with a high demand for rental properties, often sees significant pressure on tenants.

Conversely, Óscar Gorgues, manager of the Cambra de Propietat Urbana de Barcelona (Barcelona Urban Property Chamber), expressed concerns. He believes the regulation creates “legal uncertainty.” Mr Gorgues anticipates an increase in litigation regarding its application. This perspective reflects the challenges property owners face with evolving housing legislation in a dynamic urban environment like Barcelona.

Emergency Decree and Rental Caps

The Spanish government approved this extraordinary extension as part of an emergency package for the war in Iran. It benefits all contracts scheduled to end between 22 March and 31 December 2027. Additionally, the decree sets an extraordinary annual rent increase limit of 2%. This cap applies if the property owner is a large landlord. This measure aims to protect tenants from excessive rent hikes. It provides crucial stability for many households in Barcelona.
