According to Montse Bassas, vice-president of the Barcelona-Lleida Association of Property Administrators, communities can legally restrict balcony displays because they affect communal building elements. Furthermore, these restrictions can be implemented through simple majority decisions at owners’ meetings. However, such agreements only bind current residents unless statutes are formally modified.
For permanent bans affecting future residents, communities must amend their statutes with support from four-fifths of owners and participation quotas. This complex process requires notarial certification and registration at the Property Registry. Consequently, most disputes never reach courts, leaving little legal precedent about whether freedom of expression should override community rules.
Private spaces offer display opportunities
Marta Legarreta, civil law specialist at Barcelona’s Bar Association, identifies potential loopholes for determined residents. She notes that restrictions become more complicated when flags are placed in common areas designated for private use, such as the interior balcony space. Additionally, communities cannot selectively ban political symbols based on ideology while permitting others.
Temporary displays for specific occasions like the Diada or football victories rarely justify community intervention, according to legal experts. Meanwhile, landlords face their own limitations when attempting to restrict tenant displays through rental agreements. Legarreta emphasises that contracts cannot prohibit symbols in private balcony areas, rendering such clauses invalid.
