Casa Buenos Aires Expropriation: Valuation Criteria Dispute
The core dispute lies in the property’s classification during valuation. The Expropriation Jury of Catalonia treated the building as a single-family home in 2022. However, the TSJC upheld the argument that this classification was inaccurate. The city previously examined similar valuation issues with innovative senior housing models like cohousing.
According to the ruling, the property’s history supports a different categorization. Although it briefly operated as a hotel in the late 19th century, it has primarily served collective purposes. These include use as a student residence, a geriatric centre, and a religious facility.
The judgement states that “the use most adjusted to reality is that of a multi-family residential building.” This rejects the single-family classification. Furthermore, this distinction is legally significant. It alters the variables used in both the comparison and residual valuation methods.

The court has ordered a “retroaction of the proceedings.” This means the calculation must be performed again using corrected multi-family criteria. While the sentence does not stipulate a specific new figure, the change suggests the final compensation will exceed €4.2 million.
Barcelona City Council initially estimated the Casa Buenos Aires expropriation would cost approximately €3.5 million. Opposition parties warned that prolonged litigation could inflate the final price. Following this ruling, municipal legal services have requested clarification. The current plan involves creating 37 social housing units for elderly people and young adults. Additionally, it includes new neighbourhood facilities. While the project continues, the financial resolution of the acquisition is now back with the valuers.
